Attorney General statement on Quartzsite

The Arizona Attorney General Tom Horne has released the following statement with regard to the ongoing Quartzsite town hall dispute:

“Normally, we do not release the results of an investigation until it has been completed. However, because this is a matter of unusual public interest, we are prepared to say that, based on review of a video of a July 10 meeting, there is reasonable cause to believe that there has been a violation of the Open Meeting Law, inasmuch as the public was excluded. The meeting was held under the misconception that an emergency meeting can be conducted without the public present.”

“Independently of the question of whether the Town Council had a legitimate reason to hold an emergency meeting, even proper emergency meetings must allow the public to be present. The exception is if there is a legitimate basis for an executive session, and the City Council did not attempt to hold a proper executive session during the emergency meeting. The investigation of this and other alleged violations of Open Meeting Laws is ongoing.”

  4. did the council act on there own, or did gilbert tell them what to do? or did the new town lawyer brannon give them this gem of an idea. no pun intended. perp walk for gilbert, brannon and all of council except the mayor. these perps have really sandbagged the mayor and q police, and q people.

  5. The council NEVER does anything on their own. Dilbert and Taft and probably Brannon too did this.

    Truth is, I’m sad to see this happen, even though it means (hopefully) the criminals will be gone

  13. Looks like the Phoenix KPHO Channel 5 news got a little more information out of Horne. Heres a statement he made to them about this, and the link to the article so ya’ll can see I’m not pulling it out of my rear.

    “If what’s involved is an innocent misunderstanding,then probably training is the remedy,” said Horne. “If there were meetings done deliberately to withhold information from the public, then there’s the possibility of people being removed from office.”

  14. “Open meeting laws are based on the premise that sunlight is the best disinfectant, and if people can see what’s going on and participate, we’ll get better discussions,” said Horne. “If people meet in secret and the public is not there, it violates the law and its our job to enforce it.”

    Mr. Horne, that was NOT a legal meeting! You can even HEAR on videotape Xavier Frausto LOCK the doors behind the Mayor.

  15. How much is Quartzite worth? I’d like to buy it & see no more of this. Eventually, Ehrenburg will have more to offer off of the I-10 & the rock hounds will migrate leaving only Q-zite trash blowing along the highway…

    A man in Bloomington, MN has run afoul of local bird feeding statutes, and he could spend up to 90 days in jail for the offense. Craig Brown has said he wanted to make his yard a haven for birds. And local law allows for the installation of bird feeders as long as they are 5 feet off of the ground.

    But neighbors claim that brown has been dropping seeds on the ground in his yard- which apparently constitutes a misdemeanor. Brown refuses to plead guilty, saying that the seeds fell from his feeders, and he doesn’t want a criminal offense on his record. Still, he’s removed them for the time being.

    “I am nervous,” he told WCCO-TV. “They have the right to send me to jail.”

    He faces up to 90 days in jail and a $1,000 fine.
