Yakima seeks order forcing payment

New writs are now before the Court in a motion filed by Yakima Company today seeking payment by La Paz County.

Yakima is seeking an order requiring the County to immediately pay Yakima all funds not otherwise appropriated or necessary to fund essential government services. It would also force the County to take “all steps to raise revenue from any available source, and pay such funds to Yakima; and prepare a budget under which the County will pay Yakima all funds not necessary to fund essential County services.”

Yakima is also asking the Court to appoint a Special Master “to work with the parties and make recommendations to the Court on resolving any disputes that may arise.”

The provision to take “all steps” to raise money may be the most powerful provision in the motion. Yakima cites examples such as “issuing bonds, obtaining a credit facility, seeking funds from the State, and disposing of County property which is not essential for government services.” This would require the County to work with the Special Master to set aside ways to pay Yakima, perhaps by some of the means that have been discussed around the negotiating table.

  3. Well, I’m a little calmer now. After thinking about this a little, I admire Jim Willit for putting up with this B O S as long as he did. A lesser person would not have waited this long.
    B O S–even after a jury of LaPaz county citizens found you and yours guilty, you continued to listen to Dan. Are you proud of the job that you have done under Dans leadership?
    I hope the good citizens have a long memory of all of you. I think that the only way out for you three is to meet with Mr Willit and beg his forgivness. Do not include Dan Field in this. I think that Mr Willit is an honorable person and he may just possibly be worked with. I would give him all the help he needs in order to rectify this situation. I pray that it’s not too late. Whatever you do, eliminate Dan Field from any further todo with this situation.

We are all poorer for Fishers actions. He has now sold his farm equipment and gave up his leases. He still has CRIT puppets and is working to get out of here before the population holds him accountable. He sold out District 1 folks to get the fair moved to Parker South and Parker folks by getting County Maintenance building to Parker South. His Parker South friends are the same good old boy club that has kept this county from moving forward since inception. He lives on Tribal land and has NEVER paid a cent in County tax. And he got us here. Viva la Fisher. And he sure hated audits! But Hey, when your buddies run the finance department why would you want audits?? And why did the Treasurer quit so suddenly? Just sayin’.

    The county lost the lawsuit to Yakama. Time to get the entire truth out on what has been done. I do believe current BOS will and has done what it can in this dilemma. It is not Dan Fields fault. It is not the fault of this BOS. I do believe it when I hear Yakama wants the entire county and did not want to negotiate. I am sure there are some Yakama cronies who have first hand knowledge.

    You not been here long, we all know this. There are people who live out of this county who like to throw their two cents. That is clear. Roth when the time comes RUN. McGuire come back and RUN. Maybe you can fix it and save us all.

  13. So these elected folks think there is a small fraternity of people who run the world, and they think they are a part of that fraternity. And as such, they think they must impose their values on those subjects under their control and influence.

    They become more paranoid of NOT being in the fraternity than they are of being wrong, or of doing more harm to those who elected them in the first place. Being “in” is the goal, and “winning” the challenge is worthy of a higher rung in the hierarchy of the fraternity, the very club that only exists in their paranoid fantasies.

  17. Jerry Mcguire from what I have heard you are at Ohio State getting a Dr. in some sort of Agricultural discipline. Stay there. And never come back to this place. Go to work in a place that would appreciate what you have to offer. This place does not. You put your ass on the line trying to recall Fisher a few years back and you saw how you and others were attacked. La Paz County is not the place for folks that care about the future. The leaders here only care about how to pad THEIR wallets and toss the rest under the bus,

    I hear you, and I’ll come clean. You implied, based on what I have said, that I “disapprove” of this board and the previous boards. I apologize if I implied this.

    Up until about 2002-2004, I was very proud of my county. This county has so many good people, the kind of people you are honored to be associated with. The folks in LPC have done amazing things throughout the years, incredible and inspiring things. They have inspired me. I feel as if I stand on the shoulders of Giants when I take a stand. Fisher was a hero to me for many years. I admired the man and idolized him. I don’t know what happened after about 2002. I talked to Fisher, and couldn’t believe what I was hearing. I assumed it was me that was wrong, or stupid, or ignorant or whatever. So I checked out, and when I checked back in, I scrutinized what I was being told. Scrutinized, not criticized. Fisher let me down, big time. Now, I criticize.

    Who do I “approve” of? There are about 80,000 governing bodies in the US. About 1.5 – 2.0% fail to pass scrutiny. I do not approve of this. Locally, I think there are many governing bodies who do well: PUSD governing board, Parker Fire Dept., NRCD Board, Extension Board, Parker Valley Irrigation Committee, and several others. I cannot think of a board that I was not crossways with at least once in my career – but, under scrutiny, they exceed, and that is what is important.

    How I feel is unimportant. It’s how you feel that is important to you, I hope. If under scrutiny, you think that given the information available, the board acted reasonable, as a reasonable person would, then regardless of your ideology, you can’t really criticize.

    This is why the Administrative Procedures Act, Open Meeting Laws and the Freedom of Information Act is so important, to me at least. To scrutinize, and that is important, in my view of democracy.

    I for one am very sorry for slamming Dan and the B O S. I have finialy realized that this situation is not of their doing.
    However, I think that we have some very intelligent people here in LaPaz county that will step forward and help all of us with this very difficult situation.
    I think we should all step back and let some new people step forward and be known.
    Mr Roth, can you possibly contain your emotions for awhile? There are good folks that would step forward if they were not afraid of you attacking them. Please put aside your comments for a while as they are not productive for the County or the Town Of Quartzsite.
    So, let’s hear from some other people that may have some very good ideas.

    SINCE I MOVED TO LA PAZ COUNTY IN 1985, I HAVE BEEN CLOSER TO THE POLITICAL ARENA THAN EVER BEFORE. OVER THE YEARS, I HAVE PERSONALLY WITNESSED UNETHICAL AND DOWNRIGHT ILLEGAL BEHAVIOR ON BEHALF OF CERTAIN ELECTED OFFICIALS, ALL OF WHICH HAS INSPIRED ME TO PAY CLOSER ATTENTION TO THE DECISIONS OF ALL POLITICANS, FROM THE FEDS, TO THE STATE, TO LA PAZ.

  30. I would like to support Mr. McGuire on his pending degree. I have no ill feeling towards him. I supported him when he was trying to recall Fisher and Eddy. I thought it would get done. Majority of the county knew what the BOS was doing back then was wrong. I do think it was all fuel by the Egos of some. What happened? Two did not run for reelection, and the one that did lost. The people were frustrated and showed it.

    This BOS came into their term and ran into an economy where the bottom fell out. The state stripped the county of a ton of money and less people traveled here to support our tax base. Not the BOS fault that happened.

    Next thing was Yakama. I do believe they have been talking with Yakama, as stated in the BOS meeting. This is what needs to be brought out into the public. We need to be informed of what is going on in the negotiations. I do not blame the BOS for exhausting all avenues before negotiations. That is their responsibility. Now that everything has been exhausted, lets see what happens.

    This BOS has been supporting audits that should have been done by the previous BOS and then some. Sounds like there is an issue in finance. How can people blame this BOS for not having the proper audits needed (which could help secure a bond “Yakama”). We were double screwed by the past BOS.

    I support whom La Paz county voters elected. No matter what party or area they are from. If it was not for the economy and what the past BOS did to this county, this would be one of the better BOS this county ever had.

    It’s NEVER the politicians fault around here! It’s the economy’s fault the Supervisors didn’t negotiate with Jim Willett like they campaigned on? It’s the fact that audits weren’t being done that we can’t make an attempt to settle this debt? We had money to hire a Supervisors husband to a high paying job that never existed. We have the money to hire John Drum’s relatives. Lots of County employees get to drive County cars filled with gas we all buy. The County Attorney wastes huge gobs of cash on political persecutions. Your excuses are like you know what and they all stink!

    If Dan Field wasn’t around to mislead this board maybe there’d be a chance at success. But they were the geniuses that hired him so that’s not going to happen.

  33. This BOS has had this problem for over 2 years! They knew what they were getting into when they stood at meet the candidate night and pledged to immediately work a deal. These folks could very well be at least as bad as the last BOS. As far as creating a Park Ranger position, WTF?? The dude threatend to sue the county and we create a new DEPARTMENT? And buy a new SUV with a nice paint job and throw $$ that was for the sheriffs dept. at him? Then hire a guy that was dismissed from a county position for alledged improprieties?? Doesn’t take a rocket scientist to see this the good ol boy network hard at work. No, these 3 could have done the right thing and actually TALKED to Willett but chose instead to hide behind the lawyers and “sorry can’t talk about it, we’re in a lawsuit”. I am going out on a ledge and saying that as of the day they took office this was THEIR problem. I am suprised that no one has blamed BUSH for this yet!

  36. This is the way it is with some of the people on here. Lost and Roth, if people do not have your views and opinions you attack and babble on. At the last BOS meeting Dan Fields laid out what this BOS has since they came in. They were negotiating while the case was going through the appellate process.

    Roth your vendetta against the BOS member you lost to and Fields is so transparent. Now that you were tried and convicted you are focused on Vederman. WOW! If someone who disagrees with you it is full on attack mode. People can be civil and get results.

    As far as the Ranger deal. I read the complaint on the sheriff recall site. It is just horrible what went on there. That is put on paper. It is a telling tail and makes some of the rumors coming out of the sheriffs department seem more viable.

    I met the new Ranger a month ago. He was in an older Ford Expedition. I asked him about some of the rumors. He did not say anything negative about the sheriffs department. I though he would be disgruntled and talk bad. He said he kept his original salary and fixed up an older car. He seemed like a nice guy. Not like some of you.

    The taxpayers have lost Millions and Millions and Millions of real dollars because of this La Paz County government. The kids of this county have to leave to have any kind of quality of life because there is no opportunity here. There is no opportunity here because the socialist loving masters here have ruined all economic development, for decades now!

My friends and I think Sam Vederman is doing a wonderful job and we hope he stays in office for a long time unless he replaces Judge Michael Burke in the future.

    Democracy is not perfect. And to think that democracy is the best form of government is also short sighted – it is the best now, but who is to know what will be best in the future? Some form of governance and freedom will eventually replace democracy. We just don’t know what and when.

    Democracy today is sticking out your face in front of the world – warts, wrinkles and all, for the whole world to see. This is what we do. We are not perfect, we have our faults, but so far, this form seems to work best. This is today’s democracy.

    My freedom ends where your freedom begins. I cannot use my power, (be it time, voice, noise or lack of respect for others, etc, whatever) to close the door and shut out others. Neither can you.

It is part of the Federalism philosophy (States Rights (individual) vs. Federal Rights (collective)). The Federal Government is both – majority rule (democracy) and republic (protection of minority rights). The outcome is a blending of both, achieved through separation of powers, and Roberts’s Rules of Order. We have the best of both philosophies – majority rule and protection of minority rights, through the Executive (democracy), the Congress (minority rights + majority rule) and the Judicial (protection of individual rights).

    The County is a democracy – majority rule. There is no Congress, or Robert’s Rule of Order to respect the rights of the minority opinion. The backstop for minority rights is the whim of the Courts.

    Again, this is my interpretation and subject to debate.

    In a nutshell, democracy is the tyranny of the majority. It never lasts, and always ends badly.

    Let’s say 51 percent of the people say all blond haired blue eyed people must pay more taxes. They even vote on it and pass a law. Does this make it right? In a democracy it would be. Or, let’s say 51 percent of the people vote in free food for anyone who doesn’t want to work. Good idea? No, but in a democracy, it’s a go. The problem with democracies is the people always find a way to vote in more for themselves and less for you. And if you are the minority, tough luck, your vote isn’t as important as the majority. This is why we were given a Republic, not a democracy, or a 50/50 version of the two.

    Even in the democracy you describe, which is an idea or understanding shared by many, the minority still have choices – they have the choice to leave (or not to be there to begin with), and to not be victimized by those “democratic” actions. As more of the minority leave and congregate elsewhere, they become the majority in their new community.

    And the community they leave behind gets smothered under the weight of their own self-serving ideology. Who is left to support the entitlement system after the “losers” have all left?

    “Community” is defined as you wish – neighborhood, common interest group, people within a category, even a race, ethnicity or socioeconomic unique identifiers: (the Hispanic community, The law enforcement community, the Bouse community, a learning community, etc..)

  79. Mr. Roth, all my friends and I talk to people all day long and we live in Parker. I think we have good insight about how the people in Parker feel about Sam Vederman and we all think he is terrific.

    Parker is close knit and everyone talks to everyone. Most of us know more than one person in law enforcement or someone that knows someone in law enforcement. The same for the courts and the lawyers.

    We like Sam Vederman from town all the way upriver to the Bill Williams bridge. That is the majority of the voters in the county. My friends and I chuckle when we discuss what you write because some of the people you praise, who also live in Parker, think Sam Vederman is going a great job. Matthew Newman and King Clapperton to name a couple.

    I can’t speak to the Quartzsite voters. That is your turf so to speak. I do know some people in Salome and Bouse and they really like Sam Vederman. Therefore, when you make your declarations about Sam Vederman they carry little weight with all due respect.

    The talk here anyway is that Sam Vederman would be a great judge. Either way the citizens of La Paz County are fortunate to have such a dedicated and knowledgable County Attorney as Sam Vederman.

    If you have such insight into this please share your thoughts about who should replace Sam Vederman.

    You should’ve been with me in Salome today. I had a meeting with a man who was royally screwed by the “Justice System” of this county. He contacted me because of my articles in The Desert Freedom Press, and my posts here.

    I’m willing to bet the complaints you get are from the Establishment. I know who most of these people are and they don’t like it when I tell the truth about them. Our County is in a severe crisis, and it’s not just the Yakima situation. That is just a symptom of the problem. There will never be prosperity and success in this county until there is a real justice system here. Why do you think a local jury awarded the maximum to Yakima? It’s because the citizens know it’s rotten to the core here and want it changed. The ones who fight me here and don’t want real positive change are in on the scam! (Sam Vederman hires out you know!)

    Lapazarisona asked me who would be better than Sam Vederman and I told him the truth. By the way I also told what I typed in about Sam to this family that has had their life literally ruined by this county’s “justice system” and they agreed with me.

    Glen Buckaloo (Sp??) sent a man to prison for a murder he [SAYS he]* did not commit. When confronted with the facts, he didn’t want to deal with it. He didn’t care! An innocent man was completely railroaded and nobody cared! Is this the kind of county you want to live in? Do you have kids? (yet) How would you feel if your kid got railroaded?

    I’m willing to bet I have more support from the real people, not the county government hacks on this site, than they do of the citizens. Really, why do they have to hide behind their handles if they are so proud of their accomplishments here? (and then call you when their feelings get hurt.) How about the feelings of the citizens that get railroaded? Isn’t that just as, if not MORE important, than what an elected or non-elected government official feels? They are PUBLIC SERVANTS aren’t they, or are they our masters like they think they are?

  83. Roth- I have no issue with the message; it’s your delivery that’s the problem. If you stayed calm, got your point across constructively, and avoided being derogatory; you’d have had zero objections from me. But I’m constantly having to moderate you, for everything from insults to libel.

    Even in your last post, your comments about the innocence of a man convicted of murder tell the story from his side only, as though it were fact, ignoring the findings of the justice system including, presumably, a judge or jury, and smearing the name of the Deputy County Attorney. A more sensible person would say, “He maintains his innocence.” You say, “An innocent person was completely railroaded…”

    I won’t stand for these smears, libelous comments and insults. Your participation is welcome otherwise, but I’m beginning to doubt that you know when you’re breaking these rules at all. One last chance.
